🌿⚖️RCEL Presents an Analysis on Collective Redress as a Mechanism for Environmental Justice

The Regional Center for Environmental Law (RCEL) presents the analysis “Collective Actions for the Protection of Rights and Interests as a Mechanism for Environmental Justice”, prepared within the framework of the “Greening Justice” project, jointly implemented by YUCOM and UTS, with the support of the Swedish International Development Cooperation Agency (SIDA).

The analysis addresses one of the key yet underdeveloped issues within the Serbian legal system: how to ensure effective civil-law protection of the environment in cases involving collective or widespread harm.

This publication is intended for policy makers, judges, legal practitioners, civil society organisations, as well as all professionals and stakeholders engaged in environmental protection and access to justice.

What does the analysis cover?

The analysis examines the possibilities and limitations of civil-law environmental protection in Serbia, with a particular focus on the use of collective actions for the protection of collective rights and interests. It includes:

  • an overview of the current legal and regulatory framework in the Republic of Serbia,
  • an analysis of relevant judicial practice in environmental disputes,
  • findings from empirical research on practical experiences and barriers in the application of civil-law mechanisms,
  • a comparative legal analysis of models from Croatia, the European Union, and the United Kingdom,
  • concrete recommendations for improving the legislative framework in Serbia.
